1. About These Terms

These Terms and Conditions ("Terms") govern your use of the Kinfill website (kinfill.com) and any purchase of products or subscriptions from Kinfill. By placing an order, you agree to be bound by these Terms.

Who we are. Kinfill B.V. is a company registered in the Netherlands. Our registered office is in Rotterdam, the Netherlands. For customer service enquiries, contact us at help@kinfill.care.

Scope. These Terms apply to all orders placed through our website by consumers in the European Union and the United Kingdom. If you are ordering from outside these regions, please contact us before placing your order.

We may update these Terms from time to time. The version in effect at the time you place your order will apply to that order.

2. Products and Orders

2.1 Product descriptions

We take care to ensure that product descriptions, images, and prices on our website are accurate. However, we do not warrant that descriptions are error-free. If a product you receive does not match its description, you are entitled to a remedy under these Terms and applicable consumer law.

2.2 Placing an order

When you place an order through our website, you are making an offer to purchase. We will send you an order confirmation by email. A binding contract is formed when we dispatch your order.

We reserve the right to refuse or cancel any order for reasons including product availability, pricing errors, or suspected fraud.

2.3 Prices and payment

All prices are displayed in euros (EUR) or pounds sterling (GBP) and include applicable VAT. Delivery charges are shown at checkout before you confirm your order.

We accept payment by credit card, debit card, and other methods displayed at checkout. Payment is taken at the time of order.

3. Subscriptions

3.1 How subscriptions work

Kinfill offers subscription plans for recurring delivery of refill products. When you subscribe, you choose a delivery frequency that suits your household. Your payment method will be charged automatically before each shipment.

3.2 Minimum commitment

Subscriptions require a minimum commitment of one (1) additional delivery after your initial order. You may not cancel your subscription before this second delivery has been fulfilled. After the minimum commitment period, you may cancel at any time.

3.3 Managing your subscription

You can manage your subscription through your account dashboard. You may skip a delivery, change your delivery frequency, or update your payment method at any time. Changes must be made at least 48 hours before your next scheduled shipment.

3.4 Cancellation

After the minimum commitment period, you may cancel your subscription at any time through your account dashboard or by contacting our customer service team. Cancellation takes effect before the next billing cycle. No refunds are given for deliveries already dispatched.

If you cancel before completing the minimum commitment, the remaining balance for the committed delivery may be charged.

4. Delivery

4.1 Delivery regions

Kinfill ships to the Netherlands, Belgium, United Kingdom, Germany, Austria, France,  and other select countries across Europe. Shipping rates vary by destination and, in some cases, package weight. For certain countries, deliveries are limited to specific metro areas only.

For Switzerland and other non EU countries: customs imports may apply upon delivery. Kinfill does not assume responsibility for customs imports. For current delivery timeframes and a full overview of shipping rates, please refer to our Shipping & Delivery page on our website.

We are not liable for delays caused by carriers or customs processing, though we will work with you to resolve any delivery issues.

4.2 Shipping and fulfilment

EU orders are fulfilled from our warehouse in the Netherlands. UK orders are fulfilled from our UK warehouse. You will receive a tracking link by email once your order has been dispatched.

4.3 Failed deliveries

If a delivery cannot be completed (e.g. incorrect address, uncollected parcel), the parcel may be returned to our warehouse. Additional shipping costs may apply for redelivery.

5. Returns and Refunds

5.1 Statutory right of withdrawal (EU / UK)

Under the EU Consumer Rights Directive (2011/83/EU) and the UK Consumer Contracts Regulations 2013, you have a statutory right to cancel your order within fourteen (14) days of receiving your goods, without giving a reason. To exercise this right, notify us in writing (email to support@kinfill.care) within the 14-day period.

You must return the goods within 14 days of notifying us. The goods must be unused, in their original packaging, and in a condition that allows resale. Return shipping costs are your responsibility unless the goods are faulty or incorrectly delivered.

5.2 Kinfill voluntary return policy

In addition to your statutory rights, we offer a 30-day return window from the date of delivery. Products must be unused and in their original packaging. Opened refill pouches cannot be returned for hygiene reasons.

Once we receive and inspect the returned item, we will process your refund to the original payment method within 14 days.

5.3 Partial refund

If a product shows signs of use or the packaging is damaged, we may apply a partial refund of up to 50% of the product value, at our reasonable discretion.

5.4 Mechanical parts warranty

Kinfill dispensers and mechanical components (pumps, spray triggers) carry a 1 year warranty from delivery. If a mechanical part is defective within this period, we will replace it free of charge. Contact us with a photo or video of the defect.

5.5 Damaged or incorrect items

If your order arrives damaged or you receive the wrong item, contact us within 7 days of delivery with a photo. We will arrange a replacement or full refund at no additional cost to you.

6. Your Rights as a Consumer

Nothing in these Terms affects your statutory rights as a consumer under applicable EU or UK law. In the EU, you are protected by the Consumer Rights Directive, the Consumer Sales and Guarantees Directive, and applicable national implementing legislation. In the UK, you are protected by the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Where any provision of these Terms conflicts with your mandatory statutory rights, your statutory rights prevail.

7. Intellectual Property

All content on the Kinfill website — including text, images, logos, product designs, and packaging — is the property of Kinfill B.V. or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent.

8. Limitation of Liability

To the fullest extent permitted by law, Kinfill’s total liability arising from or in connection with your order shall not exceed the total amount you paid for that order.

We are not liable for any indirect, incidental, or consequential damages, including but not limited to loss of profit, data, or goodwill.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

9. Data Protection and Privacy

We process your personal data in accordance with the EU General Data Protection Regulation (GDPR) and, for UK customers, the UK GDPR and the Data Protection Act 2018.

We collect and process personal data necessary to fulfil your order, manage your subscription, and communicate with you about your purchases. This includes your name, email address, delivery address, and payment information.

Your data may be shared with our logistics partner (Monta) for order fulfilment, our payment processor for transaction processing, and our customer support platform (Gorgias) for handling enquiries.

10. Complaints and Disputes

If you have a complaint about your order or our service, please contact us at herlpt@kinfill.care. We aim to resolve all complaints within 14 days.

If we cannot resolve your complaint, EU consumers may submit a complaint through the European Commission’s Online Dispute Resolution (ODR) platform at ec.europa.eu/odr. UK consumers may contact Citizens Advice or relevant alternative dispute resolution bodies.

11. Governing Law and Jurisdiction

EU customers. These Terms are governed by the laws of the Netherlands. Any dispute shall be submitted to the competent court in Rotterdam, the Netherlands. This does not affect your right to bring proceedings in the courts of your country of residence if you are a consumer, as required by applicable EU regulations.

UK customers. If you are a consumer resident in the United Kingdom, these Terms are governed by English law, and you may bring proceedings in the courts of England and Wales, Scotland, or Northern Ireland. Nothing in these Terms limits your statutory consumer rights.
